1. The terms and conditions contained herein (hereinafter referred to as "Terms") apply to the Contest conducted by NDTV Limited ("NDTV") and Mercedes-Benz (India) Limited (hereinafter referred to as ("Mercedes-Benz")

2. Your participation in the A for Adrenalin Contest (hereinafter referred to as "the Contest") will be construed as an acceptance of the Terms and by participating, entrants agree to be bound by these official rules and waive any right to claim ambiguity in the Contest or these rules . If you do not agree to any of the Terms you should not participate in the Contest. NDTV reserves the right to modify the Terms at any time.

3. This contest will commence on 15th September 2013 and shall end on 4th October 2013.

4. The contest is open to Indian Citizens residing within the geographical territory of India only.

5. Employees of NDTV & its subsidiaries/group companies and employees of MEC, Mercedes-Benz and their families are not eligible to participate in the Contest. Employees of the Company, its affiliates, its holding company; MEC, Mercedes-Benz and their family members are not eligible to participate in the Contest.

RULES OF PARTICIPATION

1. No purchase is necessary to participate in this Contest. To enter, please log on at www.ndtv.com/aclass. Fill in the on-line entry form and submit the complete entry form. Only those entries will be considered which have been completely submitted. Each contestant may submit more than one entry to participate in the Contest.

2. The entrant needs to hold a valid passport at the time of entering into the Contest.

3. Any entry information collected from the Contest shall be used only in a manner as described below and all entries shall become a property of NDTV and Mercedes Benz.

4. The company will not entertain any entries received after 4th October 2013*.

5. Winner will be selected jointly by Mercedes-Benz and NDTV in a random drawing from all eligible entries received. The participant would additionally need to clear the screening process before they shall be deemed eligible for the prize. NDTV and Mercedes- Benz reserve the right to reject the selected entry/participant in the event they fail to clear the screening process.

6. The winner will win a ticket to the Hockenheim Racing Circuit in Germany and shall get a opportunity to experience a ride with Lewis Hamilton and to interact with him. 

7. The winners of the screening process will be contacted by NDTV directly and the process to claim prizes is mentioned below:

a. Nominated representatives will email/call the winners directly by NDTV

b. The winners will be required to provide identification proof (PAN Card, Passport, other government issued ID Proof) on or before the mentioned date in winner communication. NDTV will not entertain any winners who provide the proof after this date. This list is indicative and NDTV may require any winner to produce any other document at its discretion in order to confirm his / her identity before the prize is disbursed. The mode and mechanism of the prize disbursal will be communicated to the winner by NDTV.

c. After validating the claimant's identity, Mercedes Benz will handover or the deliverables communicated in this contest.

d. The Winner shall be solely responsible to obtain the necessary visa required for the travel and NDTV or Mercedes Benz will not be responsible in case the visa is rejected.

8. Persons participating in this Contest authorize Mercedes-Benz and NDTV to send voice messages and SMS alerts/email messages including promotional messages to their telephone number or email id, using which they have participated in this Contest.

9. All prizes, including the ticket are non-transferable and no transfer, substitution or cash alternative is permitted, except by NDTV and Mercedes Benz in their sole discretion.

10. By acceptance of the prize, the winner releases Mercedes-Benz &NDTV from any and all liability for injuries, damages or expenses sustained in connection with the Contest or with the receipt or use of the prize.

11. Income tax, gift tax or any other statutory taxes, duties or levies, necessary permits as may be applicable from time to time, arising out of free Prize/s, shall be payable by the Winner/s of the respective prize/s.

12. Mercedes-Benz &NDTV would not be liable or held responsible for any lack or lapse in any communication on account of failure or delay by any of the Internet, Telecom and E-mails service provider. No correspondence in this regard will be entertained.

13. NDTV accepts no responsibility for the quality of the prize. In case of any problems with the Product the winner will need to contact Mercedes-Benz directly for the same.

14. It is the responsibility of winners to ensure their contact details are current and up to date. NDTV accepts no responsibility for Contest Prizes lost due to change of address or contact details, and there are no replacement prizes. 15. Mere participation in the Contest does not entitle you to win a prize.

16. These specific Terms and Conditions for the Contest are in addition to the general Terms of Use governing the use of all Mercedes-Benz websites including NDTV and www.facebook.com/Mercedes-Benz India

17. The Management of NDTV & its subsidiaries/group companies reserve the right to cancel / postpone /stop this Contest at its discretion or change all or any part of terms and conditions that are applicable, without giving prior intimation of any kind and being liable for any consequential losses/damages. The holding of the contest is subject to force majeure conditions.

18. Nothing here in amounts to a commitment or representation by NDTV to conduct further or other schemes/contest.

19. It is the sole responsibility of the Contestant to ensure that they are entitled to participate in this contest as per the applicable law in of the territory where they reside.

20. We are fully committed to following laws related to the collection of data and to our carefully considered policy on data collection. You are required to give us the correct details about yourself and NDTV will not be liable for any damages direct or indirect for any wrong addresses submitted.

21. NDTV retains the right to use all the information submitted by Contestant in the application form for sales, marketing and promotional purposes and to furnish such data/information to NDTV affiliates and its agents.Participation in this Contest implies acceptance of all the terms and conditions of the Contest. Acceptance of the Prize/s by the Winner constitutes permission for Mercedes-Benz &NDTV, and its affiliates to shoot videos, click photographs of the Winner/s and use the Winner's name, photographs, likeness, voice and comments for advertising and promotional purposes in any media worldwide for purposes of advertising and trade without any additional compensation whatsoever.

22. The decision of NDTV and / or its representatives, employees, directors, officers or agents with respect to the contest, any matter related thereto including the manner of choosing of winners will be final and binding on all Contestants and no questions, correspondence, enquiries, etc. on the manner of conduct of the contest from any party whatsoever will be entertained.

23. NDTV reserves the right to cancel or postpone the contest without giving any reason and shall not be held liable for any such cancellation or postponement.

24. To the extent permitted by law, NDTV or its representatives, employees, directors, officers or agents, shall not be liable for any loss suffered or sustained, to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent on the part of NDTV or its representatives, employees, directors, officers or agents.

25. In no event shall NDTV’s liability for any claim made by any Contestant for any reason exceed Rs. 5000/-.

26. By entering into this Contest, each entrant agrees that (i) any and all disputes, claims, and causes of action arising out of or in connection with the Contest or any prizes awarded, shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs, associated with entering the Contest, but in no event will attorneys' fees be awarded or recoverable; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby knowingly and expressly waives all rights to, punitive, incidental or consequential damages and/or any other damages other than actual out-of-pocket expenses. The Participant specifically agrees not to file in person/through any family member and/or any third party any applications, criminal and/or civil proceedings in any courts or forum in India against the Mercedes-Benz &NDTV and/or their directors, employees, officers, affiliates or subsidiaries to claim any damages or relief in connection with the Contest. Disputes, if any, will be subject to jurisdiction of the courts at Mumbai only.

27. Mercedes-Benz &NDTV reserves its right to change, discontinue, or extend the Contest and/or the terms and conditions thereof without requiring to give any prior notice to the participants.

28. Mercedes-Benz &NDTV is not responsible for any errors or omissions in the terms and conditions contained herein. All information provided in the Contest is provided "As is" without warranty of any kind. Mercedes-Benz &NDTV makes no representations and disclaims all express, implied and statutory warranties of any kind to the Participant and/or any third party including, without limitation, warranties as to accuracy, timeliness, completeness, merchantability, or fitness for any particular purpose.
